2. Acceptance of Terms


By accessing or using our websites or services, or by creating an account with OnWard Education, you confirm that you accept these Terms of Service and agree to comply with them.


If you do not agree to these Terms, you must not use our websites or services.


We recommend that you print or save a copy of these Terms for future reference.


3. Eligibility / Age Requirements


You must be at least 18 years old (or the age of majority in your country of residence, if higher) to create an account and use the OnWard Education service.


Users under 18 may only use the service with the involvement and supervision of a parent or legal guardian. By using our websites or services, you confirm that you meet these requirements.

These Terms of Service incorporate the following additional policies, which also apply to your use of our websites and services:

5. Changes to the Service; Suspension/Withdrawal


We may update, modify, suspend, or withdraw our services (including any free tiers and paid subscriptions) at any time to reflect business priorities, legal or regulatory requirements, or operational needs.


We will make reasonable efforts to give you notice of significant changes, suspensions, or withdrawals, but we do not guarantee continuous availability of our websites or services.


You are responsible for ensuring that all persons who access our services through your account or internet connection are aware of these Terms and comply with them.


6. Account Security


If you choose, or you are provided with, a user identification code, password, or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.


We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these Terms.

7. Intellectual Property & Use of Content (including AI restrictions)


We are the owner or licensee of all intellectual property rights in our websites, services, and the material published on them. Those works are protected by copyright laws and treaties worldwide. All such rights are reserved.


You may print or download extracts of our content for your personal, non-commercial use. You must not modify paper or digital copies of materials in any way, and you must not use any illustrations, photographs, video, or audio separately from accompanying text. Our status (and that of any identified contributors) as authors of the content must always be acknowledged.


You must not use any part of the content on our websites or services for commercial purposes without obtaining a licence to do so from us or our licensors.


We do not permit the use of our content in the creation, training, or development of artificial intelligence (AI) systems, including but not limited to machine learning models, datasets, or related products.


If you print, copy, or download any part of our services in breach of these Terms, your right to use our services will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.


8. Reliance on Information / No Professional Advice


The content on our websites and services is provided for educational purposes only. It is not intended to amount to professional, clinical, or medical advice on which you should rely.


OnWard Education does not provide medical, legal, or professional advice. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of information obtained through our services.


Although we make reasonable efforts to keep educational content accurate and up to date, we make no representations, warranties, or guarantees, whether express or implied, that such content is accurate, complete, or current.


The content provided through our services must not be used for patient care, diagnosis, or treatment purposes. It is intended solely for educational and training use. OnWard Education accepts no responsibility or liability for any clinical decisions, patient outcomes, or actions taken based on the information or materials accessed through our services.


9. Links to Third Parties


Our websites and services may contain links to other websites and resources provided by third parties. These links are provided for your information only.


Such links should not be interpreted as approval, endorsement, or recommendation by us of those websites, their operators, or any information you may obtain from them.


We have no control over the contents of those websites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.


10. User-Generated Content & Moderation


You may upload or contribute content (such as notes, comments, or other materials) to our services. You are responsible for ensuring that any content you provide complies with our Acceptable Use Policy and applicable law.


You retain ownership of any intellectual property rights in the content you upload. However, by uploading content, you grant OnWard Education a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, adapt, display, and make available that content in connection with the operation, improvement, and promotion of our services.


We may use anonymised extracts or summaries of user-uploaded content for marketing and promotional purposes. We will not use personally identifiable content for marketing without your explicit consent.


Data, insights, or analytics generated by or through the use of our services (including aggregated or anonymised data derived from user activity) are the property of OnWard Education and may be used by us for research, business development, and commercial purposes.


We reserve the right to remove or disable access to any content at our discretion if it does not comply with our Acceptable Use Policy or if we believe it may expose us or our users to harm.


You are solely responsible for securing and backing up your own contributions.


11. Liability (consumer and business users)


Nothing in these Terms excludes or limits our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and your statutory rights as a consumer under applicable law.


If you are a consumer:


You agree that you are using our services for personal, educational use only and not for commercial or business purposes.


We are not liable for any loss of profit, loss of business, business interruption, or loss of business opportunity.


We will not be responsible for any indirect or consequential loss that is not reasonably foreseeable.


If you are a business or institutional user:


We exclude all implied conditions, warranties, representations, or other terms that may apply to our services or any content on them.


We will not be liable for any indirect or consequential loss or damage, including loss of profits, revenue, goodwill, or anticipated savings.


Our total aggregate liability to you for any claims arising out of or in connection with the use of our services will not exceed the total fees paid by you for access to the services during the twelve (12) months immediately preceding the event giving rise to the claim.


12. Interactive Features / Community


At present, our services do not provide interactive community features such as chat rooms, discussion boards, or direct peer-to-peer messaging.


If we introduce such features in the future, we will update these Terms to include the relevant standards, moderation processes, and user responsibilities.


13. Acceptable Use Policy


This Acceptable Use Policy sets out the permitted and prohibited uses of our services. You must comply with both the spirit and the letter of this policy.


Prohibited uses


You may not use our services:


In any way that breaches applicable local, national, or international law or regulation.


In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.


For the purpose of harming or attempting to harm minors in any way.


To send, knowingly receive, upload, download, use, or re-use any material which does not comply with these Terms.


To transmit or procure the sending of any unsolicited or unauthorised advertising or promotional material (spam).


To knowingly introduce viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material.


Security and access


You must not:


Attempt to gain unauthorised access to our services, servers, or databases.


Attack our services via denial-of-service or similar methods.


Reproduce, duplicate, copy, or re-sell any part of our services in contravention of these Terms.


Patient data and sensitive information


You must not upload, share, or process identifiable patient data or other sensitive personal information within our services. Any content that contains such information may be removed without notice, and accounts may be suspended or terminated for breaches of this requirement.


Our rights


We may suspend, disable, or permanently remove access to our services if you breach this Acceptable Use Policy. We may also remove any material you upload if, in our opinion, it does not comply with these standards.


14. Premium Content, Pricing, Billing, and Subscriptions


Access to our services is provided through paid student licences offered on a subscription basis. The specific pricing, billing cycle (for example, weekly or yearly), and features included in each licence are clearly displayed on the relevant purchase page at the time of order.


Subscriptions and renewals


OnWard Education currently offers paid student licences on an auto renewing subscription basis. Subscription options include:

An annual subscription priced at €149.99 per year (equivalent to approximately €12.50 per month).

A monthly subscription priced at €13.99 per month.

The applicable subscription price, duration, and included features are clearly displayed in the app and on the relevant purchase screen at the time of subscription.

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current subscription term.

You may manage or cancel your subscription at any time through your account settings on our website or, if purchased via an app store, through the subscription management settings of the relevant app store. Cancelling a subscription will stop future renewals but will not affect access already granted for the current paid period.


Billing and payment


Payments may be processed through our website (via Stripe) or through third-party app stores such as Apple App Store or Google Play.


Prices are displayed in the local currency where available and may vary depending on location, exchange rate, or app store policies.


If you purchase through an app store, your payment and cancellation terms may also be subject to that store’s own terms and conditions.


Failure to pay

If payment cannot be processed (for example, due to insufficient funds or expired payment details), we reserve the right to suspend or terminate your access to the services until payment is successfully completed.


Institutional licences

Institutional licences for universities or other organisations are governed by separate agreements and are not covered by these Terms.


15. Refunds & Cooling-off Rights (EU and UK)


Under EU and UK consumer law, you have a statutory right to cancel your order within 14 days without giving any reason. The cancellation period will expire 14 days from the day of purchase.


However, by purchasing and accessing digital content immediately, you expressly consent to the immediate delivery of the content and acknowledge that you will lose your right to cancel once access begins.


Subscriptions


For subscription services, the 14-day cancellation period starts from the day of purchase.


If you cancel within this period and have not accessed the content, you are entitled to a full refund.


If you cancel within this period but have already accessed the content, refunds are at our discretion.


After the 14-day period, no statutory refund rights apply, but you may cancel future renewals as described in Section 14.


Refund process

 or, if purchased via an app store, through the app store’s refund process.


Refunds will be made using the same payment method you used for purchase.


We will process refunds without undue delay and within 14 days of confirming eligibility.


16. Changes to Terms


We may amend these Terms from time to time to reflect changes in law, regulation, business practices, or improvements to our services.


If we make material changes that affect your rights or obligations, we will provide notice by email (where possible) or by displaying a notification within our services.


Continued use of our services after the effective date of any updated Terms will constitute your acceptance of the changes.


If you are a subscription user and a change materially and negatively affects you, you may cancel your subscription before the next renewal date, and you will not be charged further fees.


17. Governing Law, Jurisdiction, and Consumer Protection


These Terms, their subject matter, and their formation are governed by the laws of Ireland. You and we agree that the Irish courts will have exclusive jurisdiction in relation to any disputes.


If you are a consumer resident in the European Union or the United Kingdom, you also benefit from any mandatory consumer protection provisions of the law of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.


18. Privacy Notice Link


Our Privacy and Cookie Policy sets out in detail how we collect, use, and protect your personal data, as well as your rights under applicable data protection laws.

This is available in-app and on our website.
